You may use the Site solely for lawful purposes and in accordance with these Terms. You represent that you are at least 18 years of age and have the legal capacity to enter into these Terms on your own behalf or on behalf of the entity you represent.

Acceptable use includes:

• Browsing and purchasing products for personal or business use.
• Submitting design files for custom decal orders.
• Contacting our support team with order-related inquiries.

Prohibited activities include, but are not limited to:

• Engaging in any conduct that restricts or inhibits any person's use or enjoyment of the Site.
• Transmitting unsolicited promotional material, spam, or any other form of automated solicitation.
• Attempting to gain unauthorized access to any portion of the Site, servers, or databases connected to the Site.
• Using automated tools (scrapers, bots, crawlers) to extract product data, pricing, or customer information without prior written consent.
• Submitting content that infringes any third party's intellectual property rights or that is defamatory, obscene, or unlawful.
• Misrepresenting your identity or affiliation with any person or organization.

We reserve the right to terminate or restrict access to the Site for any user who violates these acceptable-use requirements at our sole discretion and without prior notice.

All orders placed through the Site are subject to acceptance by Boat Decal Shop. We reserve the right to refuse or cancel any order for any reason, including but not limited to product unavailability, suspected fraud, or inaccuracies in product or pricing information.

Purchase terms:

• Pricing. All prices are listed in U.S. Dollars and are subject to change without notice. Applicable sales taxes will be calculated and displayed at checkout based on your shipping address.
• Availability. Product availability is not guaranteed. If a product becomes unavailable after your order is placed, we will notify you promptly and issue a full refund for the affected items.
• Custom Orders. Custom and personalized decals are produced to your specifications. Because these items cannot be restocked, all sales on custom orders are final once production begins, except where a manufacturing defect exists.
• Payment. Full payment is required at the time of order. We accept major credit cards and other payment methods listed at checkout.
• Shipping. Estimated delivery dates are provided in good faith but are not guaranteed. Risk of loss and title for products pass to you upon delivery to the carrier.

Returns and exchanges for non-custom items may be initiated within 30 days of delivery in accordance with our Return Policy, which is incorporated herein by reference.

All content on the Site — including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software — is the property of Boat Decal Shop or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

The Boat Decal Shop name and logo are trademarks of the Company. You may not use any Company trademark without our prior written approval. Nothing in these Terms grants you any right to use any trademark, service mark, logo, or trade name of the Company.

User-generated content:

When you submit artwork, logos, or design files for custom orders, you represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to use and authorize us to reproduce that content for fulfillment purposes. You retain ownership of your submitted designs. By submitting content, you grant Boat Decal Shop a limited, non-exclusive, royalty-free license solely to produce and ship your ordered products. We will not use your submitted designs for marketing purposes without your explicit consent.

You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site or its content for commercial purposes without our express written permission.

The Site and all products and services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that (a) the Site will be uninterrupted or error-free, (b) defects will be corrected, (c) the Site or the server that makes it available are free of viruses or other harmful components, or (d) the results of using the Site will meet your requirements.

Damages cap. To the fullest extent permitted by applicable law, Boat Decal Shop's total liability to you for any claim arising out of or relating to these Terms or your use of the Site shall not exceed the greater of (i) the amount you paid to us in the twelve (12) months preceding the claim, or (ii) one hundred U.S. dollars ($100).

In no event shall Boat Decal Shop be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, loss of data, or loss of goodwill, arising out of or in connection with these Terms or the use of or inability to use the Site, even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.

You agree to defend, indemnify, and hold harmless Boat Decal Shop and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms;
• Any content you submit, post, or transmit through the Site, including design files submitted for custom orders;
• Your violation of any law or regulation or the rights of a third party, including intellectual property rights; or
• Your use of the Site or any products purchased through the Site in a manner not authorized by these Terms.

We reserve the right, at your expense, to assume exclusive defense and control of any matter subject to indemnification by you. You agree to cooperate with our defense of these claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding upon becoming aware of it.

Governing Law & Jurisdiction. These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law provisions.

Informal Resolution. Before initiating any formal legal proceeding, you agree to contact us first and attempt to resolve the dispute informally. Please reach out via our Contact page. We will attempt to resolve the dispute within 30 days of receiving your notice.

Arbitration. If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or to your use of the Site shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

Class Action Waiver. You agree that any arbitration or proceeding shall be limited to the dispute between us and you individually. You waive your right to participate in a class action lawsuit or class-wide arbitration.

You and Boat Decal Shop agree that the courts of competent jurisdiction located in Florida shall have exclusive jurisdiction for any matters not subject to arbitration.

We reserve the right to amend these Terms at any time and at our sole discretion. When we make material changes, we will update the "Last updated" date at the top of this page and, where practicable, notify registered users by email or via a notice on the Site.

Your continued use of the Site after any such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Site immediately.

We encourage you to review these Terms periodically so that you are informed of any updates. The most current version of the Terms will always be accessible at this URL.

We may suspend or terminate your access to the Site, including any account you hold with us, at any time and without prior notice if we reasonably believe that you have violated these Terms, engaged in fraudulent activity, or if required to do so by law.

Grounds for immediate suspension or termination include, but are not limited to:

• Chargebacks or disputed transactions initiated in bad faith;
• Submitting fraudulent or stolen payment information;
• Repeated violation of our acceptable-use policy outlined in Section 01;
• Any activity that threatens the security or integrity of the Site.

Upon termination, your right to use the Site will immediately cease. If your account is terminated, we may, but are not obligated to, delete any content or information associated with your account. Provisions of these Terms that by their nature should survive termination — including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability — shall survive.

You may also terminate your account at any time by contacting us. Outstanding obligations (e.g., unpaid balances) remain due upon account termination.
